Not all cases involve support from one spouse to the other. At the court's discretion, or the request of the divorcing parties, one spouse may be required to support the other financially for a temporary or permanent basis. The obligation of one spouse to support the other financially for a temporary or permanent basis is decided on a case-by-case basis as agreed to by the parties or at the court's discretion. Both men and women are eligible for spousal support. With a temporary maintenance order, the payer makes payments of a short period of time until the recipient can provide for themselves once again; whereas permanent maintenance requires the payer to continue payments after the decree has been entered.

While spousal support is not always granted, the courts may consider several factors to determine if it should be made an award, such as:

  • Having children while married
  • The standard of living during the marriage
  • The length of the marriage
  • The income of both spouses
  • Age and marketable skills of the recipient
